Waiver and Indemnification

 

This Document has important legal consequences.  You should have appropriate legal counsel before signing it.

 

I recognize, as do the people with me, or people using my boat/watercraft/kayak/canoe that boating and the launching of any type of watercraft have an inherent risk of damage and injury associated with them.  We hereby acknowledge and agree that we are launching and using Stoner Creek Properties LLC property and boat ramp entirely at our own risk.

 

I acknowledge and agree that Stoner Creek Properties, LLC, nor its members, will not be responsible for:

 

1. Any damage to my watercraft, vehicle or other property.  This includes any theft or lose of my property.

2. Any injury to myself or people with me, or people using my boat/watercraft/vehicle including death, sustained as a result of our usage or presence on Stoner Creek Properties, LLC. Property.

 

I hereby waive any rights I may have to sue Stoner Creek Properties and its members with respect to personal injury or property damage suffered by myself/people with me/people using my boat/watercraft/vehicle as a result of our usage of boat ramp/property belonging to the Stoner Creek Properties, LLC. We release Stoner Creek Properties, LLC. and its members from any liability for such injury or damage to the fullest extent permitted by law.

 

I have taken necessary steps to ensure that myself and people with me or people using my boat or watercraft are adequately prepared to use the boat ramp and Stoner Creek Properties, LLC property.  This includes having appropriate safety equipment as may be required by law or that a prudent boater would consider having.

 

Myself and the people with me or people using my boat or watercraft accept that the decision to launch any boat/watercraft/kayak/canoe is weather dependent and accept full responsibility for deciding to launch and do not hold Stoner Creek Properties LLC. or its members responsible for our decisions.

Myself  and the people with me or people using my boat or watercraft understand that usage of the property belonging to Stoner Creek Properties LLC. is limited to the area at the boat ramp and the drive down to it.  We have no access rights to the other parts of the property and realize that restrooms are not provided on the property.   We agree to carry out our trash and all personal belongings.  We fully understand that no boats/watercraft/kayaks/canoes/trailers or personal items are to be stored on Stoner Creek Properties, LLC. property. Property access is from sunrise to sunset.
